Management or security concerns
Gov. Gavin Newsom signed a law on Saturday requiring California to house transgender inmates in prisons based on their gender identity — but only if the state does not have “management or security concerns.”
The California Department of Corrections and Rehabilitation houses men and women in separate facilities. Transgender inmates are often housed based on their sex assigned at birth. Advocates say this is dangerous, particularly for transgender women housed in facilities for men.
That’s so interesting, because you know what’s even more dangerous? Housing women in facilities for men. Which is a pity, because that’s exactly what California is doing here. Women who identify as trans aren’t going to ask to be housed with men, are they, nor are women who don’t identify as trans going to say they do in order to be housed with men. Men, on the other hand – you do the math.
It always fascinates me to see the feverish worry about tragically vulnerable men who identify as trans coupled with complete indifference to vulnerable women.
The law says officers have to ask inmates privately how they identify. That’s it; that’s the hurdle. They say how they identify then they choose which sex they want to be locked up with.
The law says the California Department of Corrections and Rehabilitation cannot deny those requests solely because of inmates’ anatomy, sexual orientation or “a factor present” among other inmates at the facility.
But the state can deny those requests if it has “management or security concerns.” If a request is denied, the state must give the inmate a written statement explaining the decision and give the inmate a “meaningful opportunity” to object.
The guy who authored the bill says there won’t be many management or security concerns.
“It’s just a false narrative about transgender people and about transgender women in particular that they’re somehow not really women and are just trying to scam their way into women’s bathrooms or facilities in order to do bad things,” [Senator Scott] Wiener said. “Overwhelmingly the people who are being victimized are trans people.”
That “somehow” is so precious – as if he just has no idea why anyone would say a man is not in fact a woman. It’s just a “false narrative” that men are not women. Ok, Senator Wiener, your house is my house, and it’s just a false narrative for you to say it’s somehow not mine.
There’s not a word in the whole piece about the safety of women.
How does one “identify” as intersex, anyway? Transgender and non-binary describe gender, while intersex describes a set of medical conditions.
@ARC: The whole project is to make nothing objective and everything subjective, so everything becomes a matter of identification. One identifies as a woman, or five-foot-six, thirty-two years old, black, intersex, or a dolphin. It doesn’t matter—you need to live “your truth”. If everything is a matter of self-verifying identification, then everyone’s reality is self-created and incontestable.
Since I am a trans-otter, does that mean if I need to be incarcerated, I can request to be sent to the zoo?
“Management and security concerns” – why do I suspect those won’t be invoked when the TW is a convicted rapist who has raped women?
Maybe the answer is a separate prison for trans. Where they will not be threatened by men in the men’s prison (a real threat even for men that do not call themselves women) nor would they threaten women in a woman’s facility. The problem is, this isn’t about safety. This is about demanding to be ‘validated’, and all that does is draw attention to the fact that they are not, in fact, really women.

It was one of the highlights of my only visit to CA a couple of years ago. The other was hiking Point Lobos and seeing a gray whale surface in Whaler’s Cove there less than a hundred yards from shore.
Can’t add to what has already been said about Gov. Newsome’s order.
There’s another good aquarium in, of all places, Jenks, Oklahoma. People were skeptical when it was proposed; it wouldn’t do anything for the town, they thought. It draws a lot of visitors. But I don’t want to live in Oklahoma again, not even as an otter.
I also love the Chicago Shedd aquarium.

So this Weiner guy says that men who claim to be women are not likely to be “just trying to scam their way” into women’s spaces because………….these men have some sort of super special honesty gene hardwired into their ladybrainz? These are transgender CRIMINALS if they are in the prison system already so why (besides the obvious answer of PENIS) does Weiner think these men are not going to lie? And the men who have not YET claimed to be women? Hey, Weiner, they are also criminals and yet you trust they won’t lie, either?
I fear there are going to be several murders of real women in women’s prisons in CA before long.
Of course, men are frequently abused or raped in a male prison, no matter whether they are trans or not.
So, honestly, if I were arrested and asked this question, would I not be tempted to identify as female just to remove this danger?
I predict an inflation of TIM just for this reason alone.
And shouldn’t the obvious solution to this whole dilemma be to make prison safe and humane for all?
