First up, IMO it’s not a well-written article. But Scientific American is not an academic science journal. It’s a popular science journal. So the interpretation of some of the science is poor. The existence of DSDs does not negate the sex binary. Is sex smushy, in a purely biological sense? Yes. Is it relevant? No.
A blurring of the lines is how biology is, there are very few absolutes. The sex binary is a way of imposing order on the phenotypic variation within a class. The historical oppression of women is not based on whether they had chimeric cells, an inactivated SRY gene, or some other chromosomal abnormality.
The definition of intersex is becoming too broad. A man whose urethral opening has not formed properly at the tip of his penis, but instead along the shaft is not intersex. It’s a bit extreme to call it phenotypic variation either. It’s a birth defect. That’s it. If you are born with only one eye, we don’t proclaim that eyes are a spectrum.
Skin color is a spectrum and, interestingly, does not correlate with ancestry. Light-skinned African Americans, for example, are no more or less African than darker skinned ones are. But African ancestry is a class of it’s own. Again, it’s smushy. But degree of African ancestry is not race. Race is perception. So is sex. This is where a lot of trans activists seize on “actually, biology supports us, see”.
But the point is, race and sex being perception is not whether you wear a dress or not. A black person cannot magically become a perceived white person without horrific medical interventions. And even then, it doesn’t work out all that well (See Jackson, Michael). Same with sex. You can indulge in overly stereotyped visions of womanhood. You can even take hormones, have surgery and insisted everyone call you Michelle and respect your pronouns. You might pass, most will not. But your perception of womanhood remains superficial and based on gender presentation.
Gender presentation is not perception of sex. If someone sees you as a man in a dress then other men will shun and even assault you for it. Women may see you as an interloper. If someone sees you as a woman with a beard, then it’s male violence for you too. Women’s reactions will range from suspicion to pity (not including the ones who celebrate your “bravery”).
The root of it all is that being a manly man with manly bits is the only thing society accepts as a full human being. Women are not men. People claiming to be men when they’re female are not men. Men claiming to be women are not men. All three of which ends in male violence.
In summary, male violence is at the root of a large part of these issues. Some trans women want access to women’s facilities for safety. The TRA’s claim to be part of that group, but if they’re aroused by that access then they are not. Trans men also want access to women’s facilities for safety. But the problem of male violence persists unopposed. Without that opposition, unisex facilities raise the danger for everyone except men. And so women must accept everyone who is in danger, because we’re the safe harbor protected by law. Therefore, the answer arrived at is to tweak the law so that “women” encompasses anyone in danger from men, opening the door to men who get a kick out of pretending to be a woman.
