What civil liberty is this exactly?
The Connecticut ACLU is working with the two trans-identified high school boys who race with the girls and scoop up all the prizes.
Two transgender high school track and field athletes responded Wednesday to a Title IX complaint alleging that the runners prevented other female runners from top finishes and potentially from college scholarships.
The complaint filed earlier this week on behalf of three female track and field athletes in Connecticut argues that the two transgender runners, both of whom were assigned male at birth but identify as female, have “competitive advantages.” The complaint seeks to overturn the policy of the state’s high school athletics governing board, the Connecticut Interscholastic Athletic Conference, which allows athletes to compete based on the gender they identify with.
Both boys are visibly much taller and more muscular than the girls on the team. Of course they have competitive advantages, and of course they’re taking advantage of trans mania to win races they would otherwise lose.
“I have faced discrimination in every aspect of my life and I no longer want to remain silent,” said Bloomfield High track and field standout Terry Miller, one of the two transgender athletes cited in the complaint. “I am a girl and I am a runner. I participate in athletics just like my peers to excel, find community and meaning in my life. It is both unfair and painful that my victories have to be attacked and my hard work ignored.”
It’s not unfair for boys to race against boys.
I wonder how supportive Terry Miller would be if all the fastest boys “identified as girls” and joined him in competing against the actual girls.
Miller, along with Andraya Yearwood, who attends Cromwell High, have been working with the American Civil Liberties Union as the complaint begins to unfold. Miller won the State Open 200-meter title for the second straight year in 2019 and won the Class S titles in the 100 and 200, as well as the New England 200-meter championship. Yearwood, who is also transgender, finished third in the 100 meters in Class S and fourth in the 100 in the State Open.
Because they were competing against girls.
The national American Civil Liberties Union staff attorney also issued a statement Wednesday, calling it “heartbreaking.”
Attacking two black young women who are simply participating in the sport they love just because they are transgender is wrong, it is dangerous, and it is distorts Title IX, which is a law that protects all students on the basis of sex,” ACLU attorney Chase Strangio said. “Efforts to undermine Title IX by claiming it doesn’t apply to a subset of girls will ultimately hurt all students.”
On the basis of sex: men are not women and women are not men.
Boys are not “a subset of girls,” even if they are trans. Boys are not girls.
Title IX:
No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.
Miller and Yearwood are boys and should compete with boys. Saying boys should compete with boys is not exclusion or denial of benefits or discrimination.

Yes, but segregated by SEX where appropriate. Not being allowed to compete against girls ≠ not being allowed to compete. This is so infuriating.
So the answer then is to allow Black boys to run as girls so no Black girl will ever win again. Got it.

Ditto the snide scare quotes. The boys do have competitive advantages. All top athletes have competitive advantages – some produce less lactic acid so allowing muscles to operate at peak power for longer; some have a larger lung capacity than average, or their blood can absorb more oxygen or burn it more efficiently, for example – but these are natural, fair advantages. Allowing boys to directly compete against girls, or men to compete against women, gives the males a distinctly unfair advantage. Not as extreme an advantage as, say, entering an Arab stallion into a donkey derby, or riding a 1000cc Kawasaki in the Tour de France, but an unfair advantage all the same.

Why? Does barring them from one league somehow prevent them from competing in the other league? Maybe they simply give up because they are not very competitive when on even terms.
No one is barring you from the male league.
Sure, but those pursuits that have sex segregation for reasons of physical differences which lead to competitive advantage / disadvantage can require you to participate as your sex rather than as your professed gender identity.
Listening does not take bravery. Speaking truth in the face of opposition does.

Also, Strangio is one of the most deranged trans activists I’ve ever encountered, and I’m including the men, the TiMs, too.

If the ACLU ever recovers some sense, future directors are going to look back at her hire and wonder what in the world people were thinking bringing such a disordered woman aboard and handing her the keys to a whole area of litigation.

Why limit it to ‘gender’? Why not make it species? That would enable those inclined to trans-speciesism to enter themselves in the Kentucky Derby, Royal Ascot or the Melbourne Cup.

Race stewards can also tell at a glance the difference between humans and horses. There are also pretty universal checks for telling the difference between male humans and female humans. They involve ticking a very small number of boxes.
Also, another way round this enormous and crucial problem is via mathematics. For every individual contestant, apply the formula C = T(1+n) to each race time; where C = corrected time, T = recorded time and n = the number of penises hanging off the contestant’s abdomen.
Worth a try, surely.

I have no doubt that institutions such as college Title IX offices have taken the law in the direction they wanted to take it, but that doesn’t have that much standing in law – the language of Title IX doesn’t actually include anything about gender. It will take a rather tortured argument to suggest that the intent of Title IX was in fact to suggest that discrimination on the basis of sex is just fine if that is necessary to ensure that discrimination on the basis of gender identity does not happen.

I was trying to point out that the actual wording of the law has nothing to do with its application in some colleges. If a student challenged their college’s application, that would surely create a backlash and/or a long trip through the legal system, ending sometime after that student has either graduated or otherwise left the college. The result is that the Title IX in those institutions will not be used to assist young female women (can’t believe just typed that) in issues involving male bodied people unfairly participating in women’s sports.

Unfair and just odd. Social justice warriors have come and they know nothing of athletics.
I used to be an elite swimmers (male) and I knew many girls on the US Olympic team whose dreams were often broken by steroid ridden female athletes. Incredibly unfair and heart breaking.
Transpeople deserve respect and many rights, but competing against females athletically, especially at the elite level, is unfair.
