Supreme Court says yes sure a president is above the law, no problem.
The Supreme Court’s liberal bloc issued blistering dissents in the Trump immunity ruling, arguing that the decision “reshapes the institution of the presidency” and “makes a mockery” of the constitutional principle that no
manis above the law.Justice Sonia Sotomayor, reading her dissent from the bench, said that “relying on little more than its own misguided wisdom … the Court gives former President Trump all the immunity he asked for and more.”
Generosity is a virtue.
The Supreme Court ruled 6-3 on ideological lines that former President Donald Trump has immunity for some of his conduct as president but not unofficial acts in the federal election interference case. The court did not determine what constitutes an “official” act in this case, leaving that to the lower court. The decision adds another hurdle and further delay to special counsel Jack Smith’s prosecution of the former president.
Which, by pure coincidence, means he won’t be prosecuted before the election, which no doubt he will win.
It’s scary shit.
One would think that what constitutes an official act would be of utmost importance in such a decision. Otherwise, this is the sort of thing that gives a president license to take normally illegal actions against political opposition. Ironically, this is exactly the thing that Trumpists protest that prosecuting Trump constitutes. That they don’t see this is scary shit.
Maybe it’s not so much that they can’t see it, but that they can’t see it being used against them. The scary part is their confidence in the immenent, permanent victory, that means their opponents will never be able to use it against them. because they will never come to power to do so.
I bet only one of them would have be extraordinarily renditioned for the other five to reconsider their decisions.
So Biden could presumably order a drone strike on Mar-a-Lago as an official act, and it would be OK? At this point, the Supreme Court might hold differently, based on the established judicial principal that different rules hold for Republicans and Democrats. To be fair, the billionaire paymasters (of Alito & Thomas, at least) have certain expectations, which are certainly more important than dusty old issues like precedent, separation of powers, and, you know, the actual Constitution.
Well, six highly educated people, supposedly versed in critical thinking where legal matters are concerned, all presumably capable of being rational, and what do they do on the eve of Independence Day? What a disaster for the USA & for the world. One barely knows what to say.
The gloom deepens. Note that this same court also declared that an official can be paid off…err given a gift…as long as the “gift” occurred after the fact.
