Insurrection, big deal
A Colorado judge on Friday allowed Donald Trump to remain on the ballot in the state’s election next year, but found that he “engaged in insurrection” by sparking the Jan. 6, 2021, attack on the U.S. Capitol by his supporters.
He did the thing that should disqualify him but he gets to stay anyway.
The ruling from Judge Sarah Wallace, which is almost certain to be appealed, rejects a bid by a group of Colorado voters to disqualify Trump under a rarely used amendment to the U.S. Constitution that bars officials who have engaged in “insurrection” from holding federal office.
I’m betting the reason the amendment is rarely used is that insurrection doesn’t happen all that often. I don’t think it’s rarely used because hey really when you think about it who cares about insurrection anyway.
Still, the judge concluded Trump’s “conduct and words were the factual cause of, and a substantial contributing factor” to the attack on the Capitol. She found that Trump “engaged in an insurrection on Jan. 6, 2021 through incitement.”
Which is why he should never be allowed anywhere near the levers of power ever again.
Huh…well, appeals courts typically rule on matters of law, and give deference to the factual findings of the trial court. If the trier of fact found that Trump engaged in insurrection, that may be all that the appeals court needs to remove him from the ballot.
Here’s hoping.
I’m surprised that Trump and his supporters haven’t decried this whole Constitution thingy as part of the Deep State they’re trying to uproot. After all, it’s what they’re actually doing.
Well, it seems as though the only part of the Constitution that means anythng to them is the 2nd Amendment, an only the part following “well-regulated militia.” And I’m sure they think that a prohibition against requiring motorcycle helmets is in there somewhere.
^ Agreed, so long as you also leave off “well regulated militia”. They accept any and all examples of the second amendment, all the way down to bumbling cosplayers and paranoid violent lone wolf survivalist types.
True, Holms, but when a black man is shot by a policeman at a routine traffic stop, they scream it was okay because he had a gun in his car. A legal gun? Legally in his car? And for that, he is shot? If he had been white, they would have been screaming for blood, and praying to the ghost of Charlton Heston for justice.
