Re ‘losing the case against Stonewall’–someone’s pointed out that if Stonewall had been found liable they would have a) increased or cemented their perceived authority and b) been able to get around it by making a cosmetic change to their policy. Ignoring Stonewall in the judgement basically means that Stonewall can say whatever they want but companies that pay attention to them may incur severe financial penalties. I’m really hoping this will make more companies (including my own) reconsider their ties to Stonewall.
It was so brave of Ms.Bailey to do this, and I’m so glad she’s won.
The Employment Tribunal usually awards a max of 5000 pounds, and they awarded her 22 000, including aggravated damages.
I have already seen TRAs saying it’s not much money, but if Ms.Bailey had wanted money she wouldn’t have done this. The point was to set a precedent and to expose what’s going on with Stonewall- and that’s been done very effectively.
Companies and legal bodies now know Stonewall gives advice that will see you losing at the Employment Tribunal. That is very bad news for an advisory group.
From what I understand, the Employment Tribunal doesn’t award costs. It’s supposed to be a relatively simple process. Stonewall and Garden Court Chambers bringing out the QCs and 400 pages of randomly thrown together information for the tribunal was meant to be intimidating and slowing down the process.
Ms Bailey crowdfunded the case. Thanks to her and Maya Forstater, women in England now have some protection against TRA bullying in their workplaces. It’s a great outcome.
