Apprentice judge
Oh, great. Who is the judge who struck down the mask mandate? A Trump appointee, age 35, rated unqualified.
US District Judge Kathryn Kimball Mizelle has been serving as a federal judge in Florida for more than a year. Notably, the Senate vote confirming her to the lifetime appointment came in mid-November 2020, after the presidential election. She had been given a “not qualified” rating by the American Bar Association, based on her limited amount of experience post-law school.
Terrific! And she’s risking people’s health and lives, especially bus drivers, for a childish and stupid idea of freedomfreedomfreedom, meaning I can do whatever I want to and other people don’t matter.
I’ve seen US lawyers, including conservatives (ex GOP), describe the reasoning employed as sophomoric and less complimentary things beside. T. Greg Doucette, whose takes seem generally pretty sharp and who is not a believer in Big Government has pinned this tweet.
Apparently the DOJ is going to appeal the decision if the CDC formally states that they consider masks to still be needed. So at least there’s that.
James, only if the CDC opt to extend the mandate past 3 May I believe.
The Republican strategy of appointing young Christian lawyers in the federal judiciary is paying off. She graduated from Lakeland Christian Academy https://www.lcsonline.org/about-lcs/my-lcs-story/kathryn-kimball-mizelle/ and then when on to law school at the University of Florida.
WIth lifetime appointments, or even seeding the courts of appeal and the Supreme Court, they are seeking a permanent governmental majority rule over us. The judges they want aren’t necessarilty qualified, as such, but they will be conservative. And live long.
The long-term project of the Federalist Society is to destroy the administrative state and judges like this is how they will do that. This one ruling says the CDC overstepped its bounds with a mask mandate. Sooner or later, they will rule that the EPA can’t enforce the Clean Water Act. And many other things we consider good.
