Life in prison for kids ok
Holding: The Eighth Amendment does not require a finding that a juvenile is permanently incorrigible before imposing a sentence of life without parole.
Judgment: Affirmed, 6-3, in an opinion by Justice Kavanaugh on April 22, 2021. Justice Thomas filed an opinion concurring in the judgment. Justice Sotomayor filed a dissenting opinion, in which Justices Breyer and Kagan joined.
This can be such a brutal country.
Kagan, Kennedy, Ginsburg, Breyer, Sotomayor were the majority in Miller v. Alabama.
All who remained of that former majority – Sotomayor, Breyer, and Kagan – dissented in Jones v. Mississippi.
Roberts, Alito, and Thomas only like stare decisis when it was their decision in the first place. Gorsuch and Barrett just do what they’re told.
Back to the world’s biggest prison system with you. There’s never money for more schools, and always money for more prisons. Hey, I’ve got an idea: seeing as how we’re going to be sentencing a lot of children to life in prison, maybe we should build schools in prison.
Kavanaugh is himself a youthful offender who has proven himself incorrigibly corrupt. He’s just lucky some Supreme Court Justice isn’t writing about him.
